Acceptance of Terms: By creating an account from the Padeligo Application, you confirm that you have read, understand, and agree to be bound by these Terms of Service (ToS). This establishes a contractual agreement between you and the publishing company of Padeligo.

Use of the application: Each time you use Padeligo, you agree to comply with and follow all the Terms of Service (ToS).

Modification of Terms: Padeligo reserves the right to modify or update these Terms of Service (ToS) at any time and without notice. These modifications may include the addition of new clauses, the deletion, or revision of existing ones based on the evolution of our services or legal requirements.

Notification of Changes: In the event of significant changes, Padeligo is committed to informing users by email at the address associated with their User account. This notification will precede the entry into force of the new conditions.

Acceptance of Changes: Continued use of the Padeligo Application after the effective date of changes to the Terms of Service (ToS) constitutes your acceptance of these changes. Distribution and Availability of the Application

Availability on App Stores: The Application is available for download on the Apple App Store and the Google Play Store. Access to and use of the Application are subject to the terms and conditions set by these platforms. We encourage you to review the terms and conditions of these platforms for more information.

Download and Installation: To use the Application, Users must download and install the Application from these platforms. Please note that the use of these services may require a User account on the respective platforms and is subject to their policies.

Application Updates

Regular Updates: The Application is regularly updated to improve the User experience, add new features, fix bugs, and ensure compatibility with the latest versions of operating systems.

Notification and Installation of Updates: Users will be informed of available updates via App Store notifications or directly within the Application. Depending on your device settings, updates may be installed automatically or require your manual action. It is recommended to install these updates to benefit from an optimal and secure experience.

Consent to Updates: By continuing to use the Application after an update, you tacitly accept the changes made.

How the Application Works

Padeligo is designed to connect padel players, facilitate the organization of matches, and create a community around this sport. The Application allows users to search for playing partners, join clubs, create and participate in matches, and interact through a messaging feature and a community space.

Recommendations for Using the Application

  • Fill in your profile with accurate information to make it easier to connect with other players.
  • Honor your commitments when you sign up for a match.
  • Behave respectfully towards other users, whether online or during physical meetings.

Rules of Use

  • Absolute Prohibition of Inappropriate Content: Any offensive, discriminatory, or inappropriate content is strictly prohibited.
  • Respect for Commitments: Users undertake to honor their participation in the matches for which they have signed up.
  • Respect for Privacy: It is forbidden to disclose the personal information of other users without their consent.
  • Respect for Intellectual Property Rights: Users must respect the intellectual property rights of others. This means not sharing, copying, or using content protected by copyright or other intellectual property rights without authorization or in accordance with applicable laws.
  • Consequences of Non-compliance: Failure to comply with these rules of appropriate use will result in disciplinary measures, including but not limited to the immediate suspension or deletion of the relevant User's account. If non-compliance with these rules causes harm or damages of any kind, the User will be held solely responsible for the consequences of their actions. It is incumbent on each User to comply with the standards of conduct established by Padeligo and to ensure that their use of the Application does not harm others or violate the rights of third parties.

Application Rights

This section details Padeligo's rights over the Application.

Padeligo reserves the right to modify, suspend, or discontinue any aspect of the Application at any time, including the availability of any feature or Content. Padeligo may also impose limits on certain features or restrict access to parts or all of the Application without notice or liability.

By accepting these Terms of Service, you acknowledge and agree that your use of Padeligo is subject to these conditions, and you undertake to comply with them.

Rights to Generated Content

This section establishes the terms relating to the ownership and use of content generated by users within the Application.

Padeligo's Rights to User-Generated Content:

  • Extended Usage Rights for Padeligo: By accepting these conditions, you grant Padeligo a non-exclusive, worldwide, perpetual, and royalty-free license to use, reproduce, adapt, publish, translate, and distribute any content you generate within the Application. This includes the right for Padeligo to use this content for commercial or non-commercial purposes, such as promotion, marketing, or the development of new products and services.

User's Rights to Personally Generated Content:

  • Freedom of Reuse by the User: Users retain the right to use, reproduce, and share the Content they have created on the Application for their own purposes, including commercial ones.
  • Attribution of Creation: When users reuse or distribute their generated content outside the Application, appropriate attribution to Padeligo as the original creation platform is appreciated but not mandatory.

Users' Rights to Content Not Personally Generated:

  • Restriction of Rights to Others' Content: It is important to note that users have no rights to content generated by other users within the Application. You may not use, reproduce, or claim rights to Content that is not your own.
  • Respect for the Intellectual Property of Others: This restriction aims to protect the intellectual property and creative rights of each User.

Sharing and Collaboration:

  • Encouragement to Share: We encourage users to share their Content from Padeligo, thus fostering a community of creativity and innovation.

Privacy and Data Protection

This section affirms Padeligo's commitment to the protection of personal data, in particular that of children, in accordance with the GDPR.

At Padeligo, the confidentiality and security of data are paramount. We are committed to protecting the personal information of our users in accordance with the regulations in force, including the General Data Protection Regulation (GDPR). Limitation of Liability

This section stipulates that Padeligo limits its liability for indirect or intangible damages related to the use of the Application, sets a monetary limit for its possible liability, and emphasizes the responsibility of users for their compliant use of the Application.

Scope of Liability

  • Disclaimer of Liability: Padeligo, its directors, employees, partners, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to, use of, or inability to access or use the Application; (ii) any conduct or content of any third party on the Application; (iii) any content obtained from the Application; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose.
  • Limitation of Monetary Liability: To the extent permitted by applicable law, the total liability of Padeligo for all claims related to the Application, including any implied warranties, is limited to the amount you have paid, if any, to use the Application, less any commission collected by app stores.
  • Applicability of Limitation: This limitation of liability applies to all damages of any kind, subject to current legal requirements. It concerns all the features, content, and services offered by Padeligo.

User Responsibility: Users acknowledge that they are responsible for their use of the Application and that they will use the Application in a manner consistent with these Terms of Service (ToS).

Termination

Padeligo reserves the right to suspend or terminate a User's account in case of non-compliance with the ToS, particularly in cases of repeated absences from matches or inappropriate behavior.

General Provisions

This section defines the general legal aspects of Padeligo, including legal governance, clause separability, the entire agreement, non-waiver, the right to assign, and a warranty disclaimer, establishing the legal basis and limits of liability of the Application.

Legal Governance: These Terms of Service are governed by and interpreted in accordance with French law. Any dispute arising from or related to the use of the Application will be subject to the exclusive jurisdiction of the courts of this jurisdiction.

Invalidity and Severability: If any provision of these ToS is found by a competent court to be invalid, illegal, or unenforceable, this will not affect the validity of the other provisions of these ToS, which will remain in force.

Entire Agreement: These ToS constitute the entire agreement between users and Padeligo regarding the use of the Application and supersede all previous agreements between the parties relating to the subject matter herein.

Non-Waiver: The failure of Padeligo to exercise or enforce any right or provision of these ToS does not constitute a waiver of such right or provision.

Assignment Right: Padeligo reserves the right to assign its rights and obligations under these Terms to another company as part of a merger, acquisition, asset sale, or otherwise. Users may not assign their rights and obligations without Padeligo's prior written consent.

Disclaimer of Warranty: At Padeligo, we are committed to providing a quality User experience. However, please note that the Padeligo Application is provided "as is" and "as available". While we strive to ensure the reliability and functionality of our Application, we cannot guarantee complete absence of errors or interruptions. Thus, we cannot offer formal guarantees regarding uninterrupted performance or complete absence of errors in the use of the Application. We expressly disclaim any implied warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. This clause is not intended to limit your rights as a User but to clarify the nature of our services.
