Acceptance of Terms: By creating an account from the Padeligo Application, you confirm that you have read, understand, and agree to be bound by these Terms of Service (ToS). This establishes a contractual agreement between you and the publishing company of Padeligo.

Use of the application: Each time you use Padeligo, you agree to comply with and follow all the Terms of Service (ToS).

Modification of Terms: Padeligo reserves the right to modify or update these Terms of Service (ToS) at any time and without notice. These modifications may include the addition of new clauses, the deletion, or revision of existing ones based on the evolution of our services or legal requirements.

Notification of Changes: In the event of significant changes, Padeligo is committed to informing users by email at the address associated with their User account. This notification will precede the entry into force of the new conditions.

Acceptance of Changes: Continued use of the Padeligo Application after the effective date of changes to the Terms of Service (ToS) constitutes your acceptance of these changes. We encourage you to regularly review this page to stay informed about the latest applicable conditions. If you do not agree with the new terms, you have the option to stop using Padeligo, as indicated in the section regarding termination.

"TOS": These Terms of Service, which constitute a contractual agreement between the User and the publishing company of Padeligo.

Distribution and Availability of the Application

Disponibilité sur les magasins d’Application : L’Application est disponible au téléchargement sur l'App Store d'Apple et le Google Play Store. L'accès et l'utilisation de l’Application sont soumis aux termes et conditions définis par ces plateformes. Nous vous encourageons à consulter les termes et conditions de ces plateformes pour obtenir plus d'informations.

Téléchargement et Installation : Pour utiliser l’Application, les Utilisateurs doivent télécharger et installer l'Application depuis ces plateformes. Veuillez noter que l'utilisation de ces services peut nécessiter un compte Utilisateur sur les plateformes respectives et est soumise aux politiques de ces dernières.

Mises à Jour de l'Application

Mises à Jour Régulières : L’Application est régulièrement mise à jour pour améliorer l'expérience Utilisateur, ajouter de nouvelles fonctionnalités, corriger des bugs, et assurer la compatibilité avec les dernières versions des systèmes d'exploitation.

Notification et Installation des Mises à Jour : Les Utilisateurs seront informés des mises à jour disponibles via les notifications des App Stores ou directement dans l'Application. Selon les paramètres de votre appareil, les mises à jour peuvent être installées automatiquement ou nécessiter votre action manuelle. Il est recommandé d'installer ces mises à jour pour bénéficier d'une expérience optimale et sécurisée.

Consentement des Mises à Jour : En continuant à utiliser l’Application après une mise à jour, vous acceptez tacitement les modifications apportées.

Utilisation de l'Application

Accès à l'Application

Pour accéder aux fonctionnalités de l'Application, les Utilisateurs doivent créer un compte via les méthodes de connexion proposées.

Fonctionnement de l'Application

Padeligo est conçue pour mettre en relation des joueurs de padel, faciliter l'organisation de matchs et créer une communauté autour de ce sport. L'Application permet aux utilisateurs de rechercher des partenaires de jeu, de rejoindre des clubs, de créer et participer à des matchs, et d'interagir via une fonction de messagerie et un espace communautaire.

Recommandations d'utilisation de l'Application

Remplissez votre profil avec des informations précises pour faciliter la mise en relation avec d'autres joueurs.
Respectez vos engagements lorsque vous vous inscrivez à un match.
Ayez un comportement respectueux envers les autres utilisateurs, que ce soit en ligne ou lors des rencontres physiques.

Règles d'utilisation

Interdiction Absolue du Contenu Inapproprié : Tout contenu offensant, discriminatoire ou inapproprié est strictement interdit.
Respect des Engagements : Les utilisateurs s'engagent à honorer leur participation aux matchs auxquels ils se sont inscrits.
Respect de la Vie Privée : Il est interdit de divulguer des informations personnelles d'autres utilisateurs sans leur consentement.
Respect des Droits de Propriété Intellectuelle : Les utilisateurs doivent respecter les droits de propriété intellectuelle d'autrui. Cela implique de ne pas partager, copier ou utiliser des contenus protégés par des droits d'auteur ou d'autres droits de propriété intellectuelle sans autorisation ou conformément aux lois applicables.

Conséquences du Non-respect : Le non-respect de ces règles d'usage approprié entraînera des mesures disciplinaires, incluant mais non limitées à la suspension immédiate ou la suppression du compte de l'Utilisateur concerné. Si le non-respect de ces règles entraînait des torts ou dommages de quelque nature que ce soit, l'Utilisateur serait tenu pour seul responsable des conséquences de ses actions. Il incombe à chaque Utilisateur de respecter les normes de conduite établies par Padeligo et de veiller à ce que son utilisation de l'Application ne porte pas préjudice à autrui ni ne viole les droits de tiers.

Droits de l’Application

Cette section détaille les droits de Padeligo sur l’Application.

Padeligo se réserve le droit de modifier, suspendre, ou interrompre tout aspect de l'Application à tout moment, y compris la disponibilité de toute fonctionnalité ou Contenu. Padeligo peut également imposer des limites à certaines fonctionnalités ou restreindre l'accès à des parties ou à l'ensemble de l'Application sans préavis ni responsabilité.

En acceptant ces Conditions Générales d'Utilisation, vous reconnaissez et acceptez que votre utilisation de Padeligo est soumise à ces conditions, et vous vous engagez à les respecter.

Droits sur les Contenus Générés

Cette section établit les termes relatifs à la propriété et à l'utilisation des contenus générés par les utilisateurs au sein de l’Application.

Droits de Padeligo sur les Contenus Générés par l’Utilisateur :

Droits d'Utilisation Étendus pour Padeligo : En acceptant ces conditions, vous accordez à Padeligo une licence non exclusive, mondiale, perpétuelle et libre de droits pour utiliser, reproduire, adapter, publier, traduire et distribuer tout contenu que vous générez au sein de l'Application. Cela inclut le droit pour Padeligo d'utiliser ces contenus à des fins commerciales ou non commerciales, telles que la promotion, le marketing, ou le développement de nouveaux produits et services.

Droits de l'Utilisateur sur les Contenus Générés Personnellement :

Liberté de Réutilisation par l'Utilisateur : Les Utilisateurs conservent le droit d'utiliser, de reproduire et de partager les Contenus qu'ils ont créés sur l’Application pour leurs propres fins, y compris commerciales.
Attribution de la Création : Lorsque les utilisateurs réutilisent ou distribuent leurs contenus générés en dehors de l'Application, une attribution appropriée à Padeligo en tant que plateforme de création originale est appréciée mais non obligatoire.

Droits des Utilisateurs sur les Contenus Non Générés Personnellement:

Restriction de Droits sur les Contenus d'Autrui : Il est important de noter que les utilisateurs n'ont aucun droit sur le contenu généré par d'autres utilisateurs au sein de l’Application. Vous ne pouvez pas utiliser, reproduire ou réclamer des droits sur du Contenu qui n'est pas le vôtre.
Respect de la Propriété Intellectuelle d'Autrui : Cette restriction vise à protéger la propriété intellectuelle et les droits créatifs de chaque Utilisateur.

Partage et Collaboration :

Encouragement au Partage : Nous encourageons les utilisateurs à partager leur Contenu issu de Padeligo, favorisant ainsi une communauté de créativité et d'innovation.

Confidentialité et Protection des Données

Cette section affirme l'engagement de Padeligo envers la protection des données personnelles, en particulier celles des enfants, conformément au RGPD.

Limitation de Responsabilité

Cette section stipule que Padeligo limite sa responsabilité pour les dommages indirects ou intangibles liés à l'utilisation de l'Application, fixe une limite monétaire pour sa responsabilité éventuelle, et souligne la responsabilité des utilisateurs pour leur utilisation conforme de l'Application.

Scope of Liability

Disclaimer of Liability: Padeligo, its directors, employees, partners, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to, use of, or inability to access or use the Application; (ii) any conduct or content of any third party on the Application; (iii) any content obtained from the Application; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose.
Limitation of Monetary Liability: To the extent permitted by applicable law, the total liability of Padeligo for all claims related to the Application, including any implied warranties, is limited to the amount you have paid, if any, to use the Application, less any commission collected by app stores.

Applicability of Limitation: This limitation of liability applies to all damages of any kind, subject to current legal requirements. It concerns all the features, content, and services offered by Padeligo.

User Responsibility: Users acknowledge that they are responsible for their use of the Application and that they will use the Application in a manner consistent with these General Terms of Use (GTU).

Termination

Padeligo reserves the right to suspend or terminate a User's account in case of non-compliance with the GTU, particularly in cases of repeated absences from matches or inappropriate behavior.

General Provisions

This section defines the general legal aspects of Padeligo, including legal governance, clause separability, the entire agreement, non-waiver, the right to assign, and a warranty disclaimer, establishing the legal basis and limits of liability of the Application.

Legal Governance: These General Terms of Use are governed by and interpreted in accordance with French law. Any dispute arising from or related to the use of the Application will be subject to the exclusive jurisdiction of the courts of this jurisdiction.

Invalidity and Severability: If any provision of these GTU is found by a competent court to be invalid, illegal, or unenforceable, this will not affect the validity of the other provisions of these GTU, which will remain in force.

Entire Agreement: These GTU constitute the entire agreement between users and Padeligo regarding the use of the Application and supersede all previous agreements between the parties relating to the subject matter herein.

Non-Waiver: The failure of Padeligo to exercise or enforce any right or provision of these GTU does not constitute a waiver of such right or provision.

Assignment Right: Padeligo reserves the right to assign its rights and obligations under these Terms to another company as part of a merger, acquisition, asset sale, or otherwise. Users may not assign their rights and obligations without Padeligo's prior written consent.

Disclaimer of Warranty: At Padeligo, we are committed to providing a quality User experience. However, please note that the Padeligo Application is provided "as is" and "as available". While we strive to ensure the reliability and functionality of our Application, we cannot guarantee complete absence of errors or interruptions. Thus, we cannot offer formal guarantees regarding uninterrupted performance or complete absence of errors in the use of the Application. We expressly disclaim any implied warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. This clause is not intended to limit your rights as a User but to clarify the nature of our services.
